Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and [Fishbole Pty Ltd], ACN [ACN] (“Fishbole”, “we”, “us”, “our”), a company incorporated in Australia. They govern your use of the Fishbole website and platform (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Who can use Fishbole
- You must be able to form a binding contract to use the Service.
- Students use Fishbole through their school or teacher. Where a student is a minor, access is arranged by the school or teacher under the school’s authority, and the school is responsible for any parental or guardian consent required by law. Students should not create accounts independently of their school.
- If you use the Service on behalf of a school or organisation, you confirm you are authorised to accept these Terms for that organisation.
2. Your account
- You are responsible for keeping your login details secure and for activity under your account.
- Provide accurate information when creating an account and keep it up to date.
- Tell us promptly at privacy@fishbole.io if you believe your account has been accessed without authorisation.
3. The Service
Fishbole lets users create short video presentations built on slides — including recording chapters, connecting Google Slides, and sharing presentations by link, invitation, or embed. We may update, add, or remove features over time to improve the Service.
4. Your content
- You keep ownership of the content you create or upload — your slides, recordings, notes and other materials (“Your Content”).
- You grant Fishbole a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, and display Your Content solely to operate and provide the Service to you and the people you share it with. This licence ends when you delete the content or your account, except for copies that may remain briefly in backups.
- You are responsible for Your Content and confirm you have the rights to use and share it, and that it does not infringe anyone else’s rights or break any law.
5. Acceptable use
You agree not to use the Service to:
- Break any law or infringe anyone’s rights, including intellectual property or privacy rights;
- Upload or share content that is unlawful, harmful, harassing, abusive, or otherwise inappropriate — particularly given the Service’s use by students in schools;
- Attempt to gain unauthorised access to the Service or disrupt its operation;
- Misuse, resell or exploit the Service outside its intended educational and presentation purpose.
We may suspend or terminate access that breaches these Terms.
6. Plans, billing and cancellation
- Fishbole offers a Free plan and paid plans (currently Personal and School). Current pricing is shown on our Pricing page.
- Paid subscriptions are billed in advance on a recurring basis (monthly or, where offered, annually) through our payment provider, Stripe.
- Unless stated otherwise, subscriptions renew automatically until cancelled. You can cancel at any time; cancellation takes effect at the end of the current billing period.
- Except where required by law (including under the Australian Consumer Law), payments are non-refundable.
- We may change pricing; we will give reasonable notice of changes affecting your plan.
7. Third-party services
The Service integrates with third-party services such as Google Slides. Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services.
8. Intellectual property
The Service itself — including its software, design, branding and content we provide (but excluding Your Content) — is owned by Fishbole or our licensors and is protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms.
9. Availability and changes
We aim to keep the Service available and reliable but do not guarantee it will be uninterrupted or error-free. We may modify, suspend, or discontinue parts of the Service, and will give reasonable notice where practical.
10. Termination
- You may stop using the Service and delete your account at any time from your settings.
- We may suspend or terminate your access if you breach these Terms or if necessary to protect the Service or other users.
- On termination, your right to use the Service ends. Sections that by their nature should survive (such as content ownership, disclaimers, and limitation of liability) will survive.
11. Consumer guarantees and disclaimers
Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or other law that cannot be lawfully excluded.
To the extent permitted by law, and subject to those non-excludable rights, the Service is provided “as is” and “as available”, and we exclude implied warranties not expressly stated in these Terms.
12. Limitation of liability
To the extent permitted by law, and subject to the consumer guarantees referred to in section 11:
- Fishbole is not liable for indirect, incidental, special or consequential loss;
- Our total liability arising out of or in connection with the Service is limited to the amount you paid us for the Service in the twelve months before the event giving rise to the liability (or, for consumer guarantees that cannot be excluded, the resupply of the service or the cost of resupply).
13. Governing law
These Terms are governed by the laws of Australia. You and Fishbole submit to the non-exclusive jurisdiction of the courts of Australia for any dispute arising out of or in connection with these Terms or the Service.
14. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date and, where appropriate, notify you. Continued use of the Service after changes take effect means you accept the updated Terms.
